1. Welcome to Wataku

Welcome to Wataku.

These Terms of Service (“Terms”) govern your access to and use of the Wataku website, applications, online services, gameplay, Academy, artificial intelligence features, community features, digital content, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

2. Eligibility

You may use Wataku only if:

you are legally permitted to enter into this agreement under the laws applicable to you;
you comply with these Terms;
your account has not been suspended or terminated.

If you are under the age required by applicable law to enter into a binding agreement, you may use Wataku only with any legally required parental or guardian involvement.

3. Your Account

To access certain features, you may need to create a Wataku account.

You agree to:

provide accurate information;
keep your information reasonably up to date;
maintain the confidentiality of your login credentials;
notify Wataku if you believe your account has been compromised.

You are responsible for activity that occurs through your account unless resulting from unauthorized access beyond your reasonable control.

4. Account Ownership

Each account is intended for use by a single individual.

Unless expressly authorized by Wataku:

accounts may not be sold;
accounts may not be transferred;
accounts may not be shared for competitive advantage;
accounts may not be rented.

Wataku may require reasonable verification of account ownership when providing customer support.

5. The Wataku Services

Wataku provides an online strategy gaming platform that may include:

multiplayer gameplay;
AI opponents;
AI coaching and analysis;
Academy lessons;
puzzles;
rankings;
statistics;
replays;
profile customization;
community features;
digital purchases.

Features may change over time as the platform evolves.

6. Acceptable Use

You agree to use Wataku responsibly.

You must not:

violate applicable law;
interfere with platform security;
attempt unauthorized access;
distribute malware;
disrupt servers;
exploit bugs for unfair advantage;
impersonate another person;
harass other users;
publish illegal or offensive content;
interfere with the normal operation of the Services.

7. Fair Play

Fair competition is fundamental to Wataku.

You must not:

cheat;
manipulate ratings;
intentionally lose games to influence rankings;
create multiple accounts for abusive purposes;
collude with other players;
exploit software defects;
manipulate matchmaking;
automate gameplay using unauthorized software.

Wataku may investigate suspected violations.

Actions may include:

warnings;
temporary restrictions;
rating adjustments;
removal from events;
suspension;
permanent account termination.

8. Artificial Intelligence

Wataku includes AI-powered features.

AI may be used to:

explain rules;
analyze games;
teach strategy;
provide coaching;
generate educational content.

AI responses are generated automatically and may occasionally contain errors or incomplete information.

Players remain responsible for their own gameplay decisions.

AI-generated suggestions are provided for educational purposes.

9. Academy

The Wataku Academy is intended to help players learn the game.

Academy content is educational.

Completion of Academy lessons does not guarantee competitive performance or mastery.

10. Digital Purchases

Wataku may offer optional digital products.

Purchases are voluntary.

Purchasing digital content does not provide ownership of Wataku itself.

Digital purchases may include:

Founder’s Pack;
cosmetic items;
future optional content.

Availability may vary over time.

11. Founder’s Pack

The Founder’s Pack is intended to recognize early supporters.

Unless otherwise stated:

it is a one-time digital purchase;
it does not provide gameplay advantages;
it does not create ownership in Wataku;
it does not grant equity;
it does not grant voting rights;
it does not establish a partnership or employment relationship.

Additional terms applicable to the Founder’s Pack may be published separately.

12. Payments

Payments are processed by trusted third-party payment providers, including Stripe.

Wataku does not store your complete payment card information.

Payment-related issues may require cooperation between Wataku and the payment provider.

13. Intellectual Property

Wataku and its content, including but not limited to:

game rules;
graphics;
artwork;
software;
source code;
sounds;
music;
logos;
trademarks;
Academy content;
AI personalities;
documentation;

are protected by applicable intellectual property laws.

Except where expressly permitted, you may not:

copy;
reproduce;
modify;
distribute;
sell;
reverse engineer;
create derivative works from

Wataku content without authorization.

Nothing in these Terms transfers ownership of Wataku intellectual property to users.

14. User Content

Where Wataku permits user-generated content, you retain ownership of the content you create.

By submitting content to Wataku, you grant Wataku a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as reasonably necessary to operate and promote the Services.

You remain responsible for content you submit.

15. Availability

Wataku strives to provide reliable service.

However, uninterrupted availability cannot be guaranteed.

The Services may occasionally experience:

maintenance;
updates;
outages;
feature changes;
technical issues.

Wataku may modify, improve, suspend, or discontinue features as the platform evolves.

16. Beta Features

Some functionality may be identified as experimental or beta.

Beta features:

may change without notice;
may contain defects;
may be discontinued;
may generate unexpected results.

Your use of beta features helps improve the platform.

17. Community Standards

Users are expected to contribute positively to the Wataku community.

Examples of unacceptable behavior include:

harassment;
hate speech;
threats;
abusive language;
discriminatory conduct;
deliberate disruption of community spaces.

18. Suspension and Termination

Wataku may suspend or terminate accounts that:

violate these Terms;
threaten platform security;
engage in fraud;
repeatedly violate community standards;
abuse payment systems;
engage in serious cheating.

Where appropriate, Wataku may issue warnings before stronger enforcement actions.

Nothing in this section limits rights or obligations required under applicable law.

19. Disclaimer of Warranties

The Services are provided on an “as available” and “as is” basis, except where otherwise required by applicable law.

To the fullest extent permitted by law, Wataku makes no guarantee that:

the Services will always be uninterrupted;
every feature will always be available;
AI responses will always be accurate;
every defect will be immediately corrected;
gameplay will always be free from technical issues.

Nothing in these Terms excludes warranties that cannot legally be excluded.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Wataku shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Services.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

21. Indemnification

You agree, to the extent permitted by law, to indemnify and hold Wataku harmless from claims arising from:

your violation of these Terms;
unlawful use of the Services;
infringement of third-party rights caused by your actions.

22. Privacy

Your use of Wataku is also governed by the Wataku Privacy Policy.

The Privacy Policy forms an important part of your relationship with Wataku.

23. Changes to the Services

Wataku may introduce:

new features;
gameplay updates;
balance changes;
AI improvements;
visual improvements;
additional services.

These changes are part of the ongoing development of the platform.

24. Changes to These Terms

Wataku may update these Terms from time to time.

When material changes are made, Wataku will update the “Last Updated” date and, where appropriate, notify users through the Services.

Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.

25. Governing Law

These Terms are governed by the laws specified by Wataku at the time of commercial operation, subject to any mandatory consumer protection laws that apply to users in their place of residence.

The governing jurisdiction will be identified before public commercial launch.

26. Contact

Questions regarding these Terms may be submitted through the official Wataku contact information published on the website before commercial launch.

27. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Wataku regarding your use of the Services, except where applicable law provides otherwise.

28. Severability

If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions will continue in effect to the maximum extent permitted.

29. No Waiver

Failure by Wataku to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
